At PostHarvest our goal is to use advanced technology and data insights to reduce food waste during the post-harvest chain and increase the yield and output of our client’s produce. To achieve this mission, our SaaS and Atmos unit monitors and collects operational data. This policy is designed to affirm our commitment to maintaining the confidentiality and integrity of that data, ensuring compliance with privacy laws, whilst enabling the data-driven solutions essential to your success. This policy is subject to the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth).
Introduction
1.1 This privacy policy outlines how PostHarvest Learning Pty Ltd (ABN 11 632 773 089) (PostHarvest, we, us our) manage your Personal Information (PI) when you access and use our services, including and not limited to our SaaS platform and Hardware (Services).
1.2 We respect the rights and privacy of all individuals and are committed to complying with the Privacy Act 1988 (Cth) (The Act) and the Australian Privacy Principles, and other relevant privacy legislation.

2. What is Personal Information?
2.1 In this Privacy Policy, ‘Personal Information’ has the meaning given to it in Section 6 of the Act. In general terms, Personal Information is any information or combination of information that can be used to personally identify you.
2.2 Personal information may include your name, age, location, post code and contact details. It may include location data and financial information. If the information we collect personally identifies you, or you are reasonably identifiable from it, then the information will be deemed Personal Information.

4. What happens if we can’t collect your personal information?
4.1 We may not be able to provide or update some or all of our services to you if you choose not to provide us with Personal Information.
5. How and why we collect and use Personal information and Operational Data
5.1 The primary purpose for collecting your Personal Information is to enable us to provide you with our Services, as detailed below. We may use Personal Information to generate insights for viewing on the Platform, however, the insights will be limited to viewing by you and our dedicated team, unless you request and consent to share the insights with third parties.
5.2 We may also use your Personal Information for secondary purposes closely related to the Primary.
5.3 You consent to us collecting, using, storing, sharing and disclosing your personal information to:
5.3.1 Provision of Core Services: To deliver, administer, and manage the contracted Services (including providing access to the protected areas of the platform and generating specific data insights for customer viewing).
5.3.2 Product Maintenance and Improvement: To research, develop, and improve the Services, and to maintain or update the platform to ensure the best version possible.
5.3.3 Customer Communication: To communicate with you, respond to inquiries, and notify you about the Website and essential service updates (including legally required notices).
5.3.4 Legal and Contractual Compliance: To comply with legal obligations, a request by a governmental agency or regulatory authority, or a legally binding court order.
5.3.5 Enforcement and Security: To detect, investigate, and prevent potentially unlawful acts or omissions, enforce our Terms of Use and Privacy Policy, and protect a person’s rights, property, or safety.
5.3.6 Business Processing: To conduct business processing functions, including providing necessary Personal Information to our contractors, service providers, or other third parties to facilitate the delivery of our products.
5.3.7 Data De-identification and Aggregation: To combine or aggregate data and/or make Personal Information anonymous so that it cannot be used to identify you. This de-identified data is then used for internal research, developing new solutions, and for commercial or business purposes (including selling the aggregated data).
5.3.8 Verification and Accuracy: To verify information for accuracy or completeness (including by way of verification with third parties).
5.3.9 Dispute Resolution: To resolve disputes and to identify, test, and resolve problems with the Services.
5.3.10 Marketing and Promotion (Consent-Based): To supply you with generalised, targeted, or personalised marketing, advertising, and promotional notices, offers, and communications about our Services (you retain the right to opt out).
5.3.11 Sharing Insights (Consent-Based): To allow you to directly share Your Information or platform insights with third parties of your choosing, such as a third-party service provider.
If you access the Website from a shared device or a device of a third party (such as in an internet café), your personal information may also be available to other persons who access that device.
6. When do we disclose Personal Information?
6.1 To enable us to deliver the Services to you, we may disclose your Personal Information:
To our employees, contractors or licensees;
To external third-party service providers, with your consent (see clause 7); or
To comply with legal obligations, including the resolution of disputes or complaints.
6.2 If we are involved with a merger, acquisition or asset sale, your Personal Information may be transferred to the other party. We will provide you notice before your personal information is transferred and becomes the subject of a different privacy policy.
7. How we use external service providers (Including Outside Australia)
7.1 We may provide your Personal Information to other third parties, with your consent.
8. How can you access or correct your Personal Information and Operational Data?
8.1 You may request access to any Personal Information we hold at any time by contacting us at info@postharvest.com
8.2 Where we hold information that you are entitled to access, we will try to provide suitable means of accessing the information. We will not charge you for making a request, unless the requests are excessive and repetitive with no valid reasoning. There will be no charge for making corrections to your Personal Information.
8.3 If you make an access request, we may ask you to verify your identity. There may be instances where we cannot grant you hold. For instance, we may need to refuse access if granting access would interfere with the privacy of others, or if it would result in a breach of confidentiality. If that happens, we will give written reasons for any refusal.
8.4 If you believe that Personal Information we hold about you is incomplete, incorrect or inaccurate, then you may request us to amend it.
8.5 We request that you keep information as current as possible so that we can continue to improve and provide quality services to you.
9. How do we ensure that your Personal Information and Operational Data is secure?
9.1 We will take all reasonable steps and implement security measures to ensure that your Personal Information that we hold is protected from accidental or unlawful destruction, accidental loss, alteration, unauthorized disclosure or access and misuse.
9.2 If you suspect misuse, loss, unauthorized access to your Personal Information, please contact us immediately (see Section 10).
9.3 If we suspect any misuse, loss or unauthorised access to your Personal Information, we may inform you of that suspicion and take immediate steps to limit any further access or distribution of your Personal Information. If we determine that the breach is likely to result in serious harm to you and we are unable to prevent the likely risk of serious harm with remedial action, we will take action in accordance with the notifiable data breaches scheme as set out in the Act.
9.4 If we receive unsolicited Personal Information that we are not permitted to collect under this Privacy Policy, or within the confines of the law, we will anonymise the data and try to make it unidentifiable as soon as practical and if it is lawful and reasonable to do so.
9.5 We will anonymise Personal Information if we no longer require it to deliver our Services as soon as practicable, and if it is lawful and reasonable to do so.
10. How can you complain about privacy and data breaches?
10.1 If you believe we have breached your privacy rights, or if you have any questions or concerns regarding this policy, please contact us by email at info@postharvest.com.
10.2 Your requests and complaints will be treated confidentially. We will contact you within a reasonable time after receipt of your complaint to discuss your concerns and outline options regarding how they may be resolved. We will aim to ensure that your complaint is resolved in a timely and appropriate manner.
10.3 If you are not satisfied with the outcome and resolution provided to you, you may request that the Office of Australian Information Commission investigate the complaint further, https://www.oaic.gov.au/.
